THE Quezon City Police District (QCPD) has filed charges against a lawyer with his three companions and another two in connection with the death of an AWOL policeman tagged as responsible for the failed ambush in Quezon City mid-week of February.
QCPD director Chief Supt. Guillermo Lorenzo T. Eleazar said that on Feb. 22, 2018, the Criminal Investigation and Detection Unit (CIDU) under Supt. Rodel Marcelo filed charges of homicide and violation of RA 10591 (unlawful possession of firearms) against lawyer Argel Joseph Cabatbat and John Ramos before the Office of the City Prosecutor in connection with the death of PO1 Mark Boquela Ayeras, said to be one of the assailants of the lawyer during the ambush.
Cabatbat’s companions, Ardee Llaneras and Rodel Dela Cruz, face homicide cases, while the lawyer’s father, George Cabatbat, was charged with violation of Section 28 of RA 10591 for unlawful acquisition or possession of firearms, and Rodolfo Domingo was charged with violation of Sec. 41 of RA 10591 for illegal transfer/registration of firearms. The elder Cabatbat bought the firearm but was not officially transferred or registered to him which was used by Ramos during the exchange of gunshots with Ayeras.
Cabatbat and his companions were on board a black Montero at 12:30 a.m. on Feb. 13, 2018, and were travelling on the north lane of EDSA when they were fired upon at the corner of East Avenue by PO1 Ayeras, a certain John Paul Napoles and a still unidentified suspect on board two motorcycles.
A running gunbattle ensued which left PO1 Ayeras dead on arrival in the hospital.
Eleazar said, “It is true that Cabatbat is the victim, but it is procedural to file the case against him and his companions John Ramos, Rodel dela Cruz and driver Ardee Llaneras, since someone was killed. We will let the prosecutor decide if the charges will be filed before the court.”
