A GERMAN national has been slapped with charges for the alleged anomalous sale of a P13-million villa of the Alargo Homes compound in Boracay.

Charged for violation of Section 5 of Presidential Decree No. 957 (Subdivision Decree) was Stefanie Dornau, widow and general manager of Hillview Equities & Resources Corporation (formerly Hillview Marketing Corporation).

In a sworn statement filed before the DOJ-Kalibo (Aklan), Jasper J. F. Rodica, a Filipino balikbayan from Barcelona-Spain, charged that Dornau sold to her a multi-million-peso house and lot in Boracay. The lot turned out to be located somewhere else.

More than eight houses valued at almost the same amount each or totaling about P130 million are located on an ‘encroached property’ being claimed by the adjoining owner. All the units were sold to mostly foreigners by Dornau/Hillview despite the encroachment.

“This mean that these unfortunate buyers who have paid in full for these expensive villas stand to lose all their investments in case this claim of the adjoining owner against Alargo Homes/Dornau/Hillview proves to be valid and justified. This issue has been subject of another civil case before the Kalibo courts and is now awaiting adjudication after about three years of litigation,” stressed Rodica in a statement.

Upon investigation and after paying for the entire purchase price, Rodica allegedly discovered that neither Hillview Marketing Corp./Stefanie Dornau has applied nor has been issued any development permit by the Department of Environment and Natural Resources.

The same firm has not been issued any license to sell by the Housing and Land Use Regulatory Board for the 20 units of villas being sold to the public by Dornau/Hillview.

The statement added that no performance bond and certificate of registration was issued to the project. The 30 percent open space requirement was also not observed.

Section 39 of PD 957 provides for a penalty of fine of P20,000 and imprisonment of not more than 10 years for the head of the corporation  found guilty of these violations. Aside from Dornau, the other officers/board directors of Hillview are Atty Joseph Tan, Atty. Paolo Teston (the latter two belonging to M.O.S.T. -- Marcos, Ochoa, Serapio & Tan Laws Firm), Don-Vic Quezon and Fernando Maronilla.
