40 cops probed for failing to attend drug trials


PHILIPPINE National Police chief Director General Nicanor Bartolome ordered the investigation of 40 police officers for their failure to attend hearings of cases for violation of Republic Act 9165 or the Comprehensive Dangerous Drugs Act of 2002 they filed in different courts, the Journal Group learned yesterday.

Bartolome instructed PNP Anti-Illegal Drugs Special Operations Task Force commander Deputy Director General Arturo Cacdac Jr. to subject the 40 police officers to pre-charge investigation for ignoring summons to attend RA 9165 hearings.

If found guilty, the 40 faces dismissal from the service.

The PNP leadership earlier ordered that all police officers acting as prosecution witness in cases for violation of RA 9165 should not be transferred or reassigned to another unit or place of work outside his/her present territorial jurisdiction.

The move is aimed at arresting the alarming number of dismissed RA 9165 cases for non-appearance of police witnesses as a result of their transfer or reassignment to other areas of responsibility leading to the poor service of court process.

The guideline also was released to strengthen the prosecution of drug cases by ensuring the attendance of government witnesses from the inception of the case until it is finally decided by the prosecutor or by the court.

Cacdac emphasized that ‘court duty is a top priority among all other police duties’ as he ordered the thorough investigation of 82 policemen, mostly assigned in Metro Manila who failed to attend court hearings that resulted in the dismissal of 62 cases for violation of RA 9165.

PNP-AIDSOTF legal officer Chief Inspector Roque Merdegia Jr. said they are also training the PNP anti-narcotics officers in the countryside on the intricacies of RA 9165.
