SIX members of the so-called Morong 43 have asked a Quezon City court to reverse its earlier decision denying their plea to freeze the P15-million worth of properties of former President now Pampanga Rep. Gloria Macapagal-Arroyo.
In their motion for reconsideration, the plaintiff-health workers through their legal counsel Edre Olalia of the National Union of Peoples’ Lawyers cited the attempt of Mrs. Arroyo to go abroad and that their belief that she may flee is not just a suspicion.
Olalia filed the said motion at the sala of QC Regional Trial Court Executive Judge Ma. Luisa Padilla, pairing judge of QCRTC Branch 226 where the civil suit against Arroyo is pending.
Last November, Judge Padilla denied the motion for a writ of preliminary attachment filed by the plaintiffs saying it is “harsh, extraordinary and summary in nature.”
The court added that the health workers failed to convince the court that Arroyo and the other defendants are about to leave the country “to defraud their creditors.”
The motion is in relation to the damage suit filed against Arroyo and 10 others for the alleged illegal detention of the Morong 43 during her term as president.
The six plaintiffs were part of the Morong 43 who were detained last year on suspicion of being communist rebels under the Arroyo administration. President Aquino later ordered their release from detention.
In their motion, the health workers pointed out that the former president tried but failed to fly abroad late last year, claiming she needed to seek treatment abroad for a rare bone disease.
“If defendant already tried to flee by making it appear that she was seriously ill, she can still do it, and the fact that she is presently under detention will definitely not stop her from doing so,” they said.
But the petitioners pointed out that their fears have factual basis, citing the former president’s own attempt to fly out of the Philippines.
“Under the circumstances, the plaintiffs’ claim that the defendants may abscond to evade liability is not a mere suspicion,” they added.
