THE Court of Appeals (CA) has junked the appeal of pyramiding convict Rosario Baladjay and affirmed her conviction for estafa.
The CA nixed the motion for reconsideration of Baladjay and affirmed the findings of the Makati Regional Trial Court (RTC).
In its resolution, the CA ruled that there were no new arguments presented by Baladjay to warrant the reversal of their decision last September 17, 2015.
It ruled to affirm the conviction for the crime of estafa against Baladjay over her pyramiding scam.
“Wherefore, the instant Motion for Reconsideration is Denied. Our Decision dated March 15, 2016 is hereby affirmed,” the CA ruled.
The CA ruled that the arguments presented by Baladjay were merely rehashed and do not warrant the reversal of their earlier findings.
Also, the appeals court stood path on affirming the July 5, 2013 ruling of the RTC of Makati City.
The case stemmed from the cases filed by complainants Elvira Giron and spouses Martin and Ma. Teresa Agustin and several other victims.
In its ruling, the CA upheld her conviction and handed down the penalty of 10 to 20 years imprisonment.
In the same ruling, the CA ordered Baladjay to pay private complainants Elvira Giron the amount of P590,000 representing the money they invested with Multitel.
