THE Supreme Court is set to release tomorrow its decision on several petitions challenging the constitutionality of Republic Act No. 10153 or the law postponing the election in the Autonomous Region of Muslim Mindanao.
Just recently, the SC issued a temporary restraining order stopping Malacañang from enforcing RA 10153 which also synchronized the ARMM election with the 2013 national elections and gave President Aquino III the power to appoint officers-in-charge until an election is held.
With the TRO, incumbent elected ARMM officials whose term of office expired last September 30 were allowed to continue discharging their duties on a holdover capacity until after the SC resolved the petitions.
Should the high court junk the petitions questioning the constitutionality of the law, the TRO would be lifted and there would no longer be any legal impediment to the appointment of OICs and the holding of the ARMM election in 2013.
But should the SC declare the law unconstitutional, the high court would direct the Commission on Elections to schedule an election in ARMM.
Several groups, led by the Office of the Solicitor General, have asked the SC to lift the TRO.
Instead of acting on the pleas immediately, the SC required the petitioners to submit their comments.
